Appeal fault determination

If you disagree with your adjuster’s assessment of fault for a crash, you have several options.

Here are the steps to appeal fault assessment:

1. Talk to your adjuster’s manager

If you disagree with fault assessment with your adjuster, ask to talk to the manager. The manager must be involved to resolve your dispute.

2. Request the Claims Assessment Review (CAR)


If you still do not agree with assessment of fault for a crash, the manager will review your concern and

You must start the dispute process within 60 days of receiving a letter of the fault assessment. Learn more about the dispute process.

4. Disputing your claim in court

If after going through the CAR process you are still not satisfied with the results, you can dispute fault assessment in small claims court. If a judge makes a decision in your favour and changes a fault decision, we will adjust your fault assessment to match the ruling.
