Claims Assessment Review

When you disagree about fault for a crash, an independent decision-maker may be able to conduct a Claims Assessment Review (CAR).

What's a Claims Assessment Review?

A CAR provides an opportunity for an independent decision-maker who's not part of ICBC to make an objective decision about fault. This decision is based on a review of a written submission from you, along with the ICBC file material for your case.

The independent decision is binding on ICBC, but not on you. If you're not satisfied with the outcome of this review, you still have the option to dispute through the courts.

How to apply

Before a CAR can happen, all dispute remedies at the claim centre must have been exhausted.

To start the CAR dispute process, you need to submit a written application. We must receive your application within 60 days of the date you received the letter about the fault assessment (letter #CL281). There is no fee for this process. Please note that any material submitted with your application (photos, flash drives, discs) will not be returned.

Injury claims not eligible

You are not eligible to dispute liability through the Claims Assessment Review if you have presented an injury claim. Please speak to a claims manager to discuss your options.
