If you don't agree with your adjuster's assessment of fault for a crash, you can have your case reviewed.
To have your case reviewed, follow these steps:
Talk to your adjuster’s manager
First, ask to talk to your adjuster's manager. The manager must be involved to resolve your dispute.
The manager reviews your case. If appropriate, the manager can change an assessment of fault.
Ask for a Claims Assessment Review
If you still don't agree with the assessment of fault, you may be eligible for a Claims Assessment Review (CAR).
There is a 60-day time limit to apply for the CAR dispute process.
If after a Claims Assessment Review you're still not satisfied, you can dispute the fault assessment in small claims court. If a judge makes a decision in your favour and changes a fault decision, we will adjust your fault assessment to match the ruling.
