Accident Benefit limitation

Q: Is there a time limit during which I have to bring an action against ICBC to preserve my right to claim benefits?

A: Yes. Under section 103 of the Insurance (Vehicle) Regulation, an insured has two years from the date of the accident, or if benefits have been paid, two years from the last benefit payment, to commence an action for benefits.

As well, if ICBC refuses a request for payment, an insured may send a Part 7 Accident Benefits - Section 103 Notice by registered mail to the claim office dealing with the insured’s benefit claim, and the date to commence an action for benefits will be extended by two years from the date the notice is received. This notice must be sent to the claim office within two years of the date of the accident.
